Rider Alerts (SMS) – Terms and Conditions of Use 

 

Please read the following information carefully before enrolling in this service. You may not enroll in or use the service without accepting these Terms and Conditions. 

 

Welcome to MVTA’s Rider Alerts service (the “SMS Service”). These Terms and Conditions of Use govern your rights and responsibilities, and MVTA’s rights and responsibilities, relating to your use of the SMS Service. 

 

Description of Service 

The SMS Service sends text message notifications to subscribers regarding detours, closures, delays, and other impacts to MVTA fixed-route and/or microtransit service (MVTA Connect). Message content and frequency will vary depending on service conditions and the routes or alert categories you select, if applicable. MVTA does not guarantee that every service impact will generate a message, that messages will be delivered without delay, or that the SMS Service will be uninterrupted or error-free. 

 

Enrollment and Consent 

By submitting your mobile telephone number and completing enrollment through the MVTA website or another MVTA-approved method, you affirmatively opt in and consent to receive automated text messages from MVTA at the mobile number provided. Consent to receive messages is not a condition of using MVTA transit service. You represent that you are the account holder for the mobile number provided, or that you have the account holder’s permission to enroll that number. 

 

Message Frequency, Fees, and Carrier Disclosures 

Message frequency varies based on service conditions. During periods of active detours, closures, or service disruptions — including inclement weather or other significant events — you may receive messages as frequently as every 15 minutes. Message and data rates may apply. Your wireless carrier’s standard messaging, data, and other rates and fees may apply to any messages sent to or received from MVTA. MVTA does not charge for the SMS Service itself.  

 

MVTA is not responsible for any charges billed to you by your wireless carrier. 

 

The SMS Service is supported on major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages. Delivery of any message is subject to effective transmission from your wireless service provider/network and is not guaranteed. Carriers are not responsible for delayed or undelivered messages. 

 

How to Opt Out or Get Help 

You may cancel the SMS Service at any time by texting STOP to 1-866-366-7126. After you send the SMS message STOP, MVTA will send you a reply message confirming that you have been unsubscribed, and you will no longer receive messages from MVTA unless you re-enroll. If you need assistance, text HELP to 1-866-366-7126, or contact MVTA customer service at 952-882-7500 or mvta@mvta.com. 

 

Terms of Service Use 

By enrolling in and using the SMS Service, I (either as an individual or an entity) agree to abide by the following Terms of Service Use. MVTA and its service providers do not guarantee the accuracy, completeness, or timeliness of any message sent through the SMS Service, and route impact information should not be relied upon as the sole source of real-time service information. Text messaging may not be secure and could be intercepted or accessed by others. Power interruptions, carrier network interruptions, and other technical failures may prevent delivery of messages. MVTA does not guarantee continuing availability of the SMS Service. 

 

I understand and agree that MVTA and its service providers are not responsible for any of the following: delayed, undelivered, or misdirected messages; privacy or security of information transmitted by text message; charges billed by my wireless carrier; hardware or software support; lost data; or failed or interrupted transmissions. I acknowledge and agree that MVTA and its service providers are not responsible for any damages, whether direct, special, incidental, or consequential, resulting from my use of the SMS Service. 

 

I hereby agree: (a) to abide by these Terms of Service Use, (b) not to violate any applicable laws, rules, regulations, or policies relating to such use, and (c) to indemnify and hold Minnesota Valley Transit Authority, its agents, employees, and service providers harmless from any damage or harm of any kind resulting from my use of the SMS Service. 

 

I have carefully read the above terms and conditions. My enrollment in and use of the SMS Service signifies my acceptance of these terms. 

 

Privacy 

Information you provide when enrolling in the SMS Service, including your mobile telephone number, is handled in accordance with MVTA’s Privacy and Security Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of information sharing described in MVTA’s Privacy and Security Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties for any purpose other than to provide the SMS Service on MVTA’s behalf. 

 

Termination and Changes to the Service 

You agree that MVTA may modify, suspend, or discontinue the SMS Service, or terminate your enrollment, at any time and without notice, for any reason, including violation of these Terms and Conditions. MVTA may also update these Terms and Conditions from time to time; continued use of the SMS Service after such changes constitutes acceptance of the revised terms. You further agree that in the event of termination or discontinuation of the SMS Service for any reason, MVTA will have no liability to you. 

 

Notice of Problems or Complaints 

If you experience a problem with the SMS Service or believe there has been a violation of these Terms and Conditions, report it by calling 952-882-7500 or by emailing mvta@mvta.com and include “SMS” in the subject line. If available, please provide: (1) the mobile number affected; (2) the date and time of the issue; (3) a description of the issue; and (4) your contact information.
